In 2012, I won Moore v. Madigan, 702 F.3d 933 (7th Cir. 2012), which struck down Illinois total ban on the carrying of defensive handguns outside the home. With this decision in Palmer, the nation’s last explicit ban of the right to bear arms has bitten the dust.
Obviously, the carrying of handguns for self-defense can be regulated. Exactly how is a topic of severe and serious debate, and courts should enforce constitutional limitations on such regulation should the government opt to regulate. But totally banning a right literally spelled out in the Bill of Rights isn’t going to fly.
My deepest thanks to the Second Amendment Foundation for making this victory possible and to my clients for hanging in there. Congratulations Americans, your capital is not a constitution-free zone. (link)

Last week we shared the story of reports from inside the Border Patrol who refused to participate in removing the Murietta protesters.   When DHS riot squads were called into action by the Obama administration the Border Patrol warned they would ‘stand down’ and not enforce -or participate in- the aggressive tactic.
In response to that article many people said such a position was hard to believe because the current federal government has so radicalized and militarized so many agencies – people simply find it hard to believe the BP law authority would refuse to obey.
I kept quiet and chose not to argue the point.    However, what many people forget is how the Obama regime began their tenure.  Remember Brian Terry, or Fast n Furious?   The Obama administration has been openly and specifically hostile to the U.S. Border Patrol boots on the ground.   The BP know this administration does not care about their personal safety.   Today’s border activity is yet another example of why, if push comes to shove, the Border Patrol will side with citizens, not the administration:

FOX EXCLUSIVE: RINCON PENINSULA, Texas — U.S. Border Patrol agents on the American side of the Rio Grande were forced to take cover Friday night when high-caliber weaponry was fired at them from the Mexican side of the river, sources told FoxNews.com.
The weapons were fired at the U.S. side of the riverbank in the area of the Rincon Peninsula across the Rio Grande from Reynosa, Mexico, at about 8:30 p.m., sources said. A simple couple.  Unsophisticated, ordinary and otherwise comfortably invisible.   Then one morning around 6:00am DHS EXECUTES A NO KNOCK RAID.

Federal DHS agents were caught on camera busting down doors, tearing a South Florida home apart and detaining a couple inside as they looked for evidence of child pornography.   Unfortunately, they raided the wrong house….

Meet the honest 27 year old single mom from PA who faces 3 years in a New Jersey prison

(Via Conservative Hideout) Shaneen Allen is no dangerous criminal. She’s a single mom working 2 jobs who’s already been robbed twice while traveling alone at night in Philadelphia. Her family suggested that she carry a gun for protection. She took a gun safety course, applied for and was granted a concealed carry permit, and bought a gun.

NEW YORK (CBSNewYork) – It was a violent night in New York City after at least 13 people were shot in incidents spanning each of the five boroughs.
As CBS 2′s Janelle Burrell reported, one of the shootings happened on Staten Island, where a man is fighting for his life after being shot in the face.
The incident happened at around 3:30 a.m. on Amboy Road in the New Dorp section of Staten Island.  Police were still on the scene Sunday morning collecting and processing evidence, including a backpack that belonged to the 42-year-old victim.

MISSISSIPPI – President Obama has not taken long to signal just how Thad Cochran will repay the debt for the quarter million dollar campaign donation from anti-gun Michael Bloomberg. A renewed push for gun control is on the horizon, and Obama is expecting great things from Bloomberg and his new anti-gun group. Now that he has a senior statesman in his hip pocket they expect to have greater success in their effort to push measures like background checks.
Obama’s attempts at gun control were defeated in 2013,

(Via Daily Caller) A St. Louis couple is likely thankful to have guns in their home after they were forced to use them to defend their daughter against two men Monday night.

The men, one of whom had an extensive rap sheet, confronted the couples’ 17-year-old daughter after she stepped outside of the house to go to her car, reports the St. Louis Post-Dispatch.

Cortez McClinton, 33, and Terrell Johnson, 31, held a gun to the girl’s head and used her as a shield as they entered the family home, where a five-year old child was also present.

The girl’s father and mother witnessed the abduction, and both retrieved their guns. When McClinton and Johnson entered, the father fired several shots, hitting both men. The girl’s mother fired one shot but missed. (more…)

(Via Fox News) Two Las Vegas police officers and one civilian were shot and killed Sunday when a gun-toting duo went on a killing spree before shooting one another dead in an apparent suicide pact, authorities say.

Las Vegas police spokesman Larry Hadfield told The Associated Press that the spree began around 11:30 a.m. Sunday when a man and woman walked into CiCi’s Pizza restaurant on North Nellis Boulevard and ambushed two officers who were eating lunch.

Sheriff Doug Gillespie identified the two officers as Alyn Beck, 42 (right), and Igor Soldo, 32 (left).  He said one of the officers was able to fire back at the suspects before dying. (more…)

Clouding the “Domestic” aspect under the guise of “radicalism” allows Holder to conflate the intentions of his goal.

WASHINGTON DC – Attorney General Eric Holder, citing an “escalating danger from self-radicalized individuals within our own borders,” said Tuesday that the Justice Department will revive a domestic terrorism task force.

The task force was established after the Oklahoma City bombing in 1995 to share information about domestic threats. It was set to meet the morning of Sept. 11, 2001, after which the country turned its focus to terror overseas.

“But now, as the nature of the threat we face evolves to including the possibility of individual radicalization via the Internet, it is critical that we return our focus to potential extremists here at home,” Holder said in a weekly video. (more…)
