Judge Emmet Sullivan is refusing to accept the three-judge appeals court ruling – which granted a writ of mandamus and instructed Sullivan to dismiss the Flynn case per the DOJ and Flynn defense unopposed motion. Today Judge Sullivan is asking the Full DC Circuit Court panel to conduct an en banc rehearing of the issues. [pdf here]

There is no guarantee the full DC Circuit will agree to the en banc request. However, given the nature of the court, it should be anticipated. What really appears to be the undiscussed background is an effort to keep dragging this issue out as long as possible. This is beyond judicial activism running amok, we have now entered the realm of judicial weaponization.

The Lawfare resistance was strongly advocating for this judicial approach. However, what we can infer from the need for Sullivan to trigger the en banc request is that no individual circuit court judge was going to do it independently (sua sponte) which was an option.

It appears Sullivan waited to see if one of them would; then, after a period of time where he identified no circuit judge would independently put himself/herself into the spotlight, Sullivan makes the en banc request himself.  The panel will likely accept the request.

Sullivan’s en banc petition essentially says his requests to have an outside amicus brief the court -on all the reasons not to accept the unopposed motion to dismiss- as commonplace; and he decries the DC appeals court mandamus decision as “a dramatic break from precedent that threatens the orderly administration of justice.”  [I think he’s stalling.]

Today the DOJ has released additional exculpatory information to the Flynn defense team surrounding hand-written notes taken by Tashina Guahar and FBI agent Peter Strzok. The 1/25/17 meeting takes place the day after two FBI agents interview Flynn at the White House.  There’s also an internal document from the DOJ dated 1/30/17, and notes by former DOJ AAG -who later became FBI counsel- Dana Boente.

[NOTE: Keep in mind the last day for Jody Hunt, Noel Francisco and Dana Boente was last Friday, July 3rd. Coincidental timing?]

The notes and internal document are filed under seal per Judge Sullivan’s prior order. However, with previous filings the documents were made public the following day; so we might see the content tomorrow.

Tashina Guahar and Dana Boente were part of the small group inside Main Justice who convinced AG Jeff Sessions to recuse.   But you don’t need to wait for the court to release the March 30, 2017, Boente notes, because we already have them.

When the special counsel team was stirring the pot for the Trump-Russia collusion hoax, they leaked the Boente notes to their allied resistance member, Rachael Maddow.   Those notes form the basis/justification for Boente signing the second renewal of the FISA warrant against Carter Page (April 2017).   James Comey called Dana Boente because he needed the FISA extended and could not call Jeff Sessions.

Comey enlisted Boente into the operation against President Trump.  Ultimately these notes form the basis for why the DOJ demanded Boente leave his position in May.  This is why Boente was removed {Go Deep}.

As Max Ehmann said in 1927 “whether or not it is clear to you, no doubt the universe is unfolding as it should.”  From an important reference point, this quote holds additional meaning when cast against the backdrop of this Bill Barr segment. [More on that later.]

This morning Maria Bartiromo released a previous segment of her interview with AG Bill Barr that was not originally broadcast.  It is a very insightful segment.  AG Barr begins by acknowledging a very key and foundational point: President Donald Trump was indeed targeted by various entities in a concerted effort to remove him from office.  Do not let the importance of just that statement alone sit without its appropriate weight.

Second, another key aspect from the attorney general perspective is highlighted at 03:30 to 03:53 where he notes the role and responsibility of media. The importance of a distinction Barr makes is subtle for most, but for CTH it’s important because of THIS.

Michael Flynn’s defense counsel, Sidney Powell, appears on Lou Dobbs tonight to discuss the defense victory in the DC Circuit Court of Appeals; and the next steps in the case.

Ms. Powell still has legal business in front of Judge Emmet Sullivan, so she obviously needs to be a little tempered at this inflection point.  That said, what an incredible job Ms. Powell has done on behalf of her client.  Remarkable legal counsel.  WATCH:

In a court filing yesterday [pdf here] the DOJ provided -initially under seal- the Flynn defense team with more exculpatory evidence.  The filing includes hand-written notes taken by FBI agent Peter Strzok in/around key dates in early January 2017.

The filing was unsealed today, and the Peter Strzok notes are released.

One of the reasons CTH has been slow on discussing this release is specifically because I am trying to accurately determine the provenance of the notes (as below).  USAO Jeff Jensen is unsure of the exact date of the notes.  Either January 3rd, 4th, or 5th… and there’s a good reason for that confusing ambiguity; which I am attempting to filter.

The notes are written by Peter Strzok during a conversation with former FBI Director James Comey; that context is important.  What the notes contain are Peter Strzok writing down what Comey relays to him from conversations with White House officials.

Repeat: The notes are Strzok writing down what Comey relays to him from conversations with the White House.   Comey is communicating to Strzok the status of opinion from various officials; those officials may include President Obama and Vice-President Biden.

President Trump’s White House Economic Advisor Kevin Hassett holds an impromptu press availability to discuss continued efforts to reopen the economy while mitigating COVID-19 impacts.

As Hassett notes in all states where the economy has reopened there is significant economic rebound including strong sales and a need for rapid reemployment. The underlying economy is very strong; the primary issue is getting all states to reopen.

The U.S. media are in ideological alignment with blue state governors and congressional democrats to hype COVID-19 panic as a method to keep the economy from reopening.  To advance this narrative the crowds during mass protects they approve of are ignored; but any crowd at an event they do not align with is used to push panic. Everyone can see this.

The New York manufacturing index shocked everyone earlier today showing a strong rebound.  The index “unexpectedly” surged 48 points in June surprising all economic forecasters.   Meanwhile, National Economic Council Chairman Larry Kudlow appears on Fox News to discuss the dynamics.

As Kudlow notes, President Trump is looking to use any potential phase-4 legislative package to inject a massive ‘America First’ boost, via tax incentives for manufacturing business interests to return to the U.S.  The administration does not see a need for additional direct spending, bailouts, or continued payments; however, this is an opportunity to provide tax incentives to boost U.S-centric economic activity.

It’s important to remember the dynamic of U.S. multinationals (Wall St), and how many of them align with Democrat and media efforts to hold down the U.S. economy. There are trillions at stake.

Former Acting Director of National Intelligence Ric Grenell discusses his prior approach toward declassifying documents behind the Obama administration’s efforts to disrupt the incoming Trump administration.

As Grenell notes the prior administration was politically focused on targeting Donald Trump and weaponizing the intelligence apparatus to disrupt the Trump administration. Grenell discusses the over-classification of documents as a tool to hide intentional wrongdoing and corrupt intent.

It’s worth noting the interview is heavily edited; which, given Ms. Bartiromo’s granular insight on the issues, may indicate some of the conversation extended beyond what would be comfortable for the current investigation to be seen in public. (Just a hunch).

Former U.S. Ambassador to Germany and former Acting Director of National Intelligence Richard “Ric” Grenell appears for a discussion with Lou Dobbs about the echo-chamber within Washington DC and the internecine relationship to the intelligence apparatus.

Ric Grenell makes a really good point when he connects how the DC political resistance would not attend the Trump inauguration, and how that same attitude just continued throughout.  President Trump’s outsider status made him a risk to the interests of the administrative state.  The DC system will not accept a ‘people’s president’, they demand approval authority permitting only one of their UniParty tribe.
