The media are focused on the “Bundy Militia” angle to the standoff in Burns Oregon, where Aamon Bundy and brothers have taken over a Malheur Wildlife Refuge Headquarters to draw attention to the plight of the Hammond family (Full Complex Back Story Here).

However, a little research (HatTip NeverTooLate) into the original legal battle reveals a rather startling update.

The initial, and regarded by many as overreaching, federal prosecution resulted in a federal court judge Michael Hogan assigning a 3-month sentence and 1-year sentence for Dwight Lincoln Hammond Jr (73) and his son, Steven Dwight Hammond (46) respectively.

Even federal Judge Hogan stated the prosecution under “terrorism statutes” itself was an overreach and he refused to assign ridiculously high sentences for behavior that almost every rancher has conducted for generations.

Those sentences were fulfilled by the father an son duo in 2013 with Steven Hammond exiting prison in January 2014.   However, it was a decision by the U.S Attorney for the State of Oregon, Amanda Marshall, who called for an appeal to the original sentencing: (more…)

It would appear Mayor Stephanie “space-to-destroy” Rawlings-Blake ended up with more human destruction than originally intended; or, perhaps not.

BALTIMORE SUN – Blood was shed in Baltimore at an unprecedented pace in 2015, with mostly young, black men shot to death in a near-daily crush of violence.

On a per-capita basis, the year was the deadliest ever in the city. The year’s tally of 344 homicides was second only to the record 353 in 1993, when Baltimore had about 100,000 more residents.

The killings were on pace with recent years in the early months of 2015 but skyrocketed after the unrest and rioting of late April. In five of the next eight months, killings topped 30 or 40 a month. (more…)

As we review the current media report for President Obama’s intentions, regarding executive office restrictions on firearms, we must remember the second term distinction between “executive orders” and “executive action“.

♦ Executive orders are those dictatorial fiats from the White House that contain an origin, at least as regarded by the Office of Legal Counsel (OLC), founded in law.

♦ “Executive actions” are the term-two preferences of President Obama and constitute dictatorial fiats that are not constitutionally based, not legal, not supported by the OLC, and will not eventually hold up under legal challenge.  The key word is “eventually”.

The Obama “executive actions” are political decisions intentionally constructed and designed to advance an ideology while creating legal conflict.  They successfully advance ‘change’ until they are overruled by state and federal courts.

An example of an “executive action” was the Deferred Action for Parents of Americans, or DAPA, amnesty program Obama rolled out in November of 2014.   DAPA was an Executive Action, not an Executive Order.

Executive Actions open barn doors.  They are never designed/intended to pass legal challenge.  They create mostly irreversible consequences.

To the best of our knowledge the entire MSM and professional punditry have yet to recognize the strategic and intentional use of executive action – and explain it to everyone. (more…)

The Baltimore prosecution team did not turn over an investigative memo to defense attorneys outlining knowledge of a prior back injury claimed by Freddie Gray.  Defense attorneys now want to explore the previously undisclosed information.

BALTIMORE – Attorneys for Officer Caesar R. Goodson Jr. have filed in court an internal police document in which officers wrote that Freddie Gray once complained of a back problem, as part of the defense’s effort to gain access to Gray’s medical records.

The document had been previously sealed, after Judge Barry Williams ruled that prosecutors failed to disclose it to defense attorneys for Officer William G. Porter until his trial was underway last month. Porter’s case ended in a mistrial when jurors failed to reach a verdict. (more…)

NEW YORK NBC – Federal officials in Rochester, New York, have arrested and charged a local man who was allegedly plotting a New Year’s Eve machete attack on diners at a local restaurant in the name of ISIS.

Emanuel Lutchman, 25, an ex-con Muslim convert with mental issues, was charged with attempting to provide material support to the terrorist group, federal prosecutors said.

The FBI says he had pledged allegiance to ISIS leader Abu Bakr al-Baghdadi, wanted to leave to U.S. to live in the caliphate, and was in contact with a reputed ISIS member in Syria — who urged him to kill non-Muslims on the holiday.

“New years [sic] is here soon. Do operations and kill some kuffar,” the overseas contact told him, the court papers allege.

The mayor of Rochester cancelled the city’s New Year’s Eve fireworks celebration Thursday so that more police could be deployed to patrol, but officials said there is no information of a credible threat. (more…)

There’s something sketchy about the entire series of events as to how San Bernardino terrorist Tashfeen Malik was able to garner a fiancee visa and enter the U.S.   Nothing about this passes the proverbial “sniff test”.

Having read, and heard numerous testimonials,  about how extensive the process is for mainly European immigrants to enter the U.S. under similar circumstances – it just appears this specific application was provided some kind of assistance to move it along so quickly with so many obvious holes in the information as provided.

Now, thanks to a congressional inquiry, we are able see the actual documents themselves; and within the information there’s even more questions, troubling questions.

House Judiciary Committee Chairman Bob Goodlatte, Republican-Virginia, who alleged over the past weekend that immigration officials “did not thoroughly vet” Malik’s application, publicly released their file on Tuesday.  It is provided below in pdf format for your review.

( Via Fox News ) The ever-widening investigation of the San Bernardino terrorist massacre has revealed at least two dubious marriages that experts say expose huge loopholes in the immigration system and continue to put national security at risk.

Federal authorities have charged Enrique Marquez with marriage fraud for his allegedly sham union with Mariya Chernykh, a Russian woman whose sister married the brother of terrorist Syed Rizwan Farook after first gaining residence through an earlier marriage. And of course, Farook’s own wife, Tashfeen Malik, who was killed along with him in a shootout with police following their Dec. 2 attack, married her way into the U.S. under suspicious circumstances. You just have to read the criminal complaint to understand how supremely jaw-dropping the entire construct against Enrique Marquez actually is.  Two things to note:

• #1.)  Pay attention to the actual 911 call by Marquez on page 26, 27 – GOOD GRIEF !
• #2.) Someone please explain to me why his “Green-Card Wife”, Mariya Chernykh, aka Mariya Gigliotti, is not also indicted.  Please explain this.

The sense of it is the FBI-DOJ people who wrote this complaint are trying to send a signal to the rest of America – around a Presidential office hell bent on avoiding reality and downplaying the content. You’ve just got to read it.

It doesn’t come as a shock that Enrique Marquez would have charges filed against him.  As the straw-purchaser for the weapons used he became a co-conspirator.  However, the specific charges have not been released.

  UPDATE 5:00pm – CHARGES: 1) Conspiring to provide material support to terrorists. 2) Making a false statement in connection with acquisition of firearms. 3) Fraud and misuse of Visas, Permits and other Documents

( Via Fox News )  The friend of the terrorist couple behind the Dec. 2 attack that left 14 dead in San Bernardino has been arrested in connection with the case, Fox News has confirmed.

Marquez began speaking with federal authorities after they raided his mother’s home over the weekend. Right after the shootings, Marquez called his mother to say he was safe, but that he wouldn’t be coming home, neighbor Lorena Aguirre told The Associated Press. He later checked into a mental health facility. It’s unclear where he is now. (more…)
