Andrew McCarthy discusses the reason why former Deputy Attorney General Rod Rosenstein had to deliver a second scope memo in August 2017 because there was no underlying crime outlined when Mueller was initiated in May 2017.
Rosenstein authorized Robert Mueller to go searching for any criminal activity.

Last month – Amid a series of documents released by the Senate Judiciary Committee [SEE HERE] there is a rather alarming letter from the DOJ to the FISA Court in July 2018 that points toward an institutional cover-up. [Link to Letter]
Keep in mind that prior to this release only the FISA court had seen this letter from the DOJ-National Security Division (DOJ-NSD). As we walk through the alarming content of this letter I think you’ll identify the motive behind the FISC order to release it.
The DOJ has finally released a less redacted version of the second special counsel scope memo, written August 2, 2017 by Deputy Attorney General Rod Rosenstein.
The second scope memo (full pdf here) authorized Robert Mueller to target Carter Page, Paul Manafort, George Papadopoulos, Michael Flynn, and an unknown entity (Richard Gates, Michael Cohen, Michael Flynn Jr. likely possibilities).
The DOJ has been hiding the second scope memo behind redactions for almost three years. A heavily redacted version was released April 2018. They are finally releasing a less redaction version today (see below). Don’t forget, the DOJ has never released or discussed the third (super secret) scope memo written on October 20, 2017.
The scope memos are important because when contrast against known evidence of investigative corruption the scope memos show how targets were selected by the Mueller team and approved by Deputy AG Rod Rosenstein. Additionally, the scope memos show what actions Mueller’s corrupt investigative authorities were looking into.
Mrs. Shelly Luther probably did not expect to take this role, but the rebellious Texas salon owner has become the face of resistance to overbearing totalitarian dictates.
Mrs. Luther opened her salon in defiance of the economic shutdown that was causing financial ruin for her and her employees.
As a result Texas Judge Eric Moye sentenced her to a week in jail. Facing massive public outcry and support for Luther the Texas Attorney General and Governor are now asking Dallas County authorities to let her out of jail.
DALLAS (CBSDFW.COM) – Texas Attorney General Ken Paxton has called for the “immediate release” of a Dallas salon owner who was arrested and sent to jail for opening her business in defiance of Gov. Greg Abbott’s stay-at-home orders.
Paxton said he believes the judge is abusing his authority and that her arrest seems like a “political stunt.” In a full statement, Paxton said:
It doesn’t come as a shock but it is ridiculous in the extreme. A Dallas County Texas salon owner has been sentenced to a week in jail for defying the order to keep her business closed. “I couldn’t feed my family and my stylists couldn’t feed their families” Ms. Shelly Luther testified. The court didn’t care.
The stakes are escalating daily as economic desperation takes over and the oppressive hand of the authoritarian government officials refuse to loosen their grip on their new found power over the population. Confrontation is likely to get much worse quickly.
TEXAS – A Dallas salon owner will spend a week in jail after she was found in contempt of court Tuesday for violating a court order to close her salon during the coronavirus pandemic.
In addition to the jail time, Shelley Luther was fined at least $3,500 for continuing to operate her business, Salon à la Mode, in violation of a temporary restraining order issued against the business.
An interesting article from Fox News asks the question of whether Mueller’s special counsel attorney Brandon Van Grack misled Judge Sullivan in the Flynn case by not being forthcoming about the background documents under the DOJ Brady obligation.
Additionally, as a consequence of the Flynn evidence discoveries people are now asking why the FBI and DOJ did not produce these documents earlier. Representative Jim Jordan is specifically asking these questions of current FBI Director Chris Wray.
In response to the Fox News article the FBI has released a statement which itself is very interesting. Apparently the FBI Director is trying to dig himself and his institution out of a hole; but it is only getting worse. First, here’s the follow-up from the FBI.
[FOX NEWS] – After this article was published, the FBI provided a statement to Fox News saying that under Wray’s leadership, the bureau had turned over relevant Flynn materials to the U.S. attorney probing possible FBI criminal misconduct during the Trump probe, John Durham — but the FBI didn’t say when exactly the handoff happened.
“Under Director Wray’s leadership, the FBI has fully cooperated and been transparent with the review being conducted by U.S. Attorney Jeff Jensen, just as it has been with U.S. Attorney John Durham and was with Inspector General Michael Horowitz,” the statement read.
Congressman Jim Jordan (R-OH) and former representative Trey Gowdy appear on Fox News to share their review of the latest Flynn documents with Maria Bartiromo.
Both Jordan and Gowdy note the driver of the FBI effort appears to be Peter Strzok who worked around his immediate superior, Bill Priestap, to work with the more politically aligned FBI Director James Comey and FBI Deputy Director Andrew McCabe.

Interesting juxtaposition in this interview. Roosterhead really wanted to avoid criticizing current FBI Director Chris Wray, and he was successful talkin’ circles. As long as the Rooster “knows” things he is satisfied and content. Why? Because it takes an actual connection with “deplorables” and “MAGA” to really fight with all they have for the greater cause…. an emotional connection missing in the Rooster yet evident in Jim Jordan.
From the Rooster’s perspective, the problem is not that people and families have continued to suffer due to ongoing DOJ prosecutorial terror-tactics; and/or the fact that fake media has fooled 50% or more of the public with their deep state fiction narrative; from the perch of the Rooster it’s all just a puzzle to outline and satisfy the appearance.
The Rooster types tell Jordan privately he’s too “ate up with it”…
Chicago Mayor Lori Lightfoot announced on Saturday that she is instructing the police superintendent to cite, arrest and jail all non-compliant residents who permit gatherings and parties in their residence. Failing to comply with the stay-at-home orders and maintain social distancing will no longer be met with a warning.
Police are authorized to deliver citations, conduct immediate arrests and potentially jail any non-compliant resident in the city of Chicago.
“This is how it is going to be: We will shut you down, we will cite you, and if we need to, we will arrest you and we will take you to jail,” Mayor Lightfoot said. “If you act like a criminal, and if you violate the law, and if you refuse to do what is necessary to save lives in this city in the middle of a pandemic we will take you to jail, period.”
Sometimes the headlines tell a story all by themselves…. That’s the case in Sacramento California where a group of frustrated and rebellious citizens sought to petition their home confinement order by using the first amendment.
Apparently protesting a governor for redress of grievances, during a time of arbitrary suspension of the first amendment to the U.S. constitution, is grounds for arrest.
As a result 33 Californians were were arrested for not complying with the governor’s order they were protesting against.
Their failure of citizens to keep distant from each-other made them scofflaws to the dictates of the state government.
Video from the scene shows California Governor Gavin Newsom ordered fully armored riot police to surround the capitol building; and face down a group of rebellious moms and business owners.
The subversives who did not remain socially distant, during their protest about having to be socially distant, were promptly arrested.
CALIFORNIA – Hundreds of people — likely more than 1,000 — crowded around the California State Capitol on Friday to protest Gov. Gavin Newsom’s social distancing orders amid a pandemic that has now killed more than 2,000 Californians.
With nary a mask in sight, protesters called Newsom a tyrant and showed their support for President Trump, evidenced by Trump 2020 gear everywhere, including for sale. But despite the president’s back-and-forth support of social distancing, most were quick to absolve him of their anger over current conditions in the Golden State.
Fox News host Tucker Carlson provided some additional insight into the Flynn documents that were filed with the court last Friday noting the potential for the documents to be unsealed tomorrow. According to an earlier report by Maria Bartiromo the documents relate to notes taken by former FBI legal counsel James Baker; and surround the events that encompassed the FBI interview of General Flynn in January 2017. In a supplement to the defense motion to dismiss [pdf here] we discover some of the evidence of prosecutorial misconduct turned over by the DOJ to the Flynn defense. Specifically Lt. General Michael Flynn’s plea was based on: (1) a framing by the FBI; and (2) a threat against Michael Flynn Jr. if his father didn’t sign the plea.
If the reports are accurate it is very likely Judge Sullivan will allow the plea to be removed. If the documents are as strong as outlined the entire case could be dismissed.
