The DOJ, Sidney Powell and the Sullivan appointed amicus John Gleeson will hold a hearing today in the courtroom of Judge Emmet Sullivan to argue the unopposed motion to dismiss the case against Michael Flynn. Oblique but BIG Release – OIG Horowitz Outlines Notification of FBI for Contractor Database Abuse…

A very interesting release from the Office of Inspector General (OIG), Michael Horowitz, [SEE HERE] outlines some very interesting information especially for those who have followed the arc of the NSA database exploitation for several years.

On its face the OIG release outlines a review and finding, actually a warning, by Horowitz’s office about FBI contractor access to “a certain national security database.”  The release is titled: “Management Advisory: Notification of Concerns Identified in the Federal Bureau of Investigation’s Contract Administration of a Certain Classified National Security Program”, and the advisory part is particularly interesting when absorbed through the prism of prior information.

Notice the date of the first notification from the OIG to the FBI, January 22nd 2020, this is a detail within the report that will be missed by most. It was little discussed on January 29, 2019, when the OIG revealed “Misconduct by Two Current Senior FBI Officials and One Retired FBI Official While Providing Oversight on an FBI Contract” [LINK] Indeed we know the OIG was reviewing FBI contractor access to the NSA database as a result of both FISA judge Rosemary Collyer and FISA judge James Boasberg reports.

On the surface of the current release the OIG is noting concerns and a warning shared with the FBI about ongoing contractor access to the NSA database; thus, a “classified national security program” becomes defined. However, in the background of this current release it appears the OIG is using this public notification as a CYA of sorts. Meaning the OIG is saying publicly they have advised the FBI of “concerns” with this database being abused.

Senate Judiciary Chairman Lindsey Graham Announces Dates and Timeline for SCOTUS Confirmation…

Senate Judiciary Chairman Lindsey Graham appears on Sunday Morning Futures to discuss the latest DC events surrounding senate investigations and the confirmation process for Supreme Court nominee Judge Amy Coney Barrett.  Senate Judiciary hearings begin October 12th, committee nomination likely October 22nd to Mitch McConnell.

As an outcome of his own can-kicking and ‘over-promise/under-deliver’ disappointments Senator Graham has diminished support from the republican base in South Carolina.  As a direct result, Graham uses this appearance to request money for his own reelection effort.

Bartiromo: “Sources Confirm No Interim Durham Report or Indictments Before Election”…

Fox News host Maria Bartiromo announced earlier today that sources have shared not to expect any interim report or outcomes from the probe by John Durham prior to the election.   Obviously for many CTH readers this will not be an unanticipated outcome; however, that alone does not mitigate disappointment.   WATCH:

A decision not to pursue honest justice due to the election is ultimately a political decision. The dynamic of worrying about the optics of the political calendar, is itself a political decision. This is the great dichotomy and weirdly irreconcilable conflict CTH previously outlined.

What Ms. Bartiromo encapsulates is in-line with my own research and interactions with people very close to the DC events. In essence, this sentiment; in combination with AG Bill Barr having a keen awareness of the undercurrent frustration outside the DC bubble; is at the heart of why USAO Jeff Jensen has been channeling information to Michael Flynn’s defense counsel Sidney Powell.

Perhaps some expanded opinion is prudent…

Absolutely Perfect – Florida Governor Introduces “Law Enforcement Protection Act”…

Yesterday Florida Governor Ron DeSantis introduced an absolutely perfect set of guidelines that will frame a new set of laws within Florida called the “Combating Violence, Disorder and Looting and Law Enforcement Protection Act.” The Florida House and Senate will take up the bill as their first order of business.  Buckets of common sense.

The legal measures and penalties [Summary Here] are direct, straight forward, specific to the current situation and absolutely pitch-perfect to immediately stop any civil disorder that would impede, impact or stop the domestic tranquility for Florida residents.  This includes the use of RICO statutes to prosecute those who organize chaos.

Remarkable, and Revealing, Interview With SSCI Chairman Marco Rubio…

Senator Marco Rubio appears on Fox News with Maria Bartiromo to discuss a variety of issues and subjects from the 2020 election to the current policies toward China and social media surveillance.

However, at the mid-point of the interview Bartiromo asks the SSCI Chairman about the committee refusal to provide Senators Grassley and Johnson with documents and transcripts from testimony previously given to the SSCI in their Russia investigation.

While explaining the reason for the refusal to share transcripts, Senator Rubio shares that all prior testimony to the committee was provided with the expressed agreement that none of the witness testimony would be shared with anyone else. A remarkably self-serving construct with the deliberate outcome of allowing strategic leaks and narrative assembly without sunlight on the actual questioning.

An additionally revealing aspect from this Rubio segment is the statement that Chairman Burr and Vice-Chair Warner have constructed committee rules that both parties must be in agreement with any process within the committee – before any action is taken. This is a key facet when we consider that Senator Warner made covert contact with Chris Steele’s lawyer Adam Waldman in 2017.
