Fox News host Maria Bartiromo announced earlier today that sources have shared not to expect any interim report or outcomes from the probe by John Durham prior to the election.   Obviously for many CTH readers this will not be an unanticipated outcome; however, that alone does not mitigate disappointment.   WATCH:

A decision not to pursue honest justice due to the election is ultimately a political decision. The dynamic of worrying about the optics of the political calendar, is itself a political decision. This is the great dichotomy and weirdly irreconcilable conflict CTH previously outlined.

What Ms. Bartiromo encapsulates is in-line with my own research and interactions with people very close to the DC events. In essence, this sentiment; in combination with AG Bill Barr having a keen awareness of the undercurrent frustration outside the DC bubble; is at the heart of why USAO Jeff Jensen has been channeling information to Michael Flynn’s defense counsel Sidney Powell.

Perhaps some expanded opinion is prudent…

President Trump appears on Fox News for an interview with Pete Hegseth to discuss the nomination of Judge Amy Coney Barrett to the supreme court.  President Trump discusses the background of the nomination and the potential opposition to Barrett’s nomination as contrast against the severe political antagonism currently in Washington DC.

Strategically the nomination of Barrett at this moment in time is very smart. No Democrat senators are going to support any nominee regardless of disposition. Why not nominate the most conservative judge possible knowing the vote will come down to pure partisan politics.

Tonight at 5:00pm President Trump is scheduled to announce his pick to fill a vacancy on the Supreme Court following the death of Justice Ruth Bader Ginsburg. Many media outlets are reporting the selection will be Amy Coney Barrett.

UPDATE:  WHITE HOUSE – Today, President Donald J. Trump announced his intent to nominate Judge Amy Coney Barrett of the U.S. Court of Appeals for the Seventh Circuit to fill the Supreme Court vacancy created by the passing of Justice Ruth Bader Ginsburg.

Judge Barrett has served as a judge on the U.S. Court of Appeals for the Seventh Circuit since 2017. Before becoming a judge, she was the Diane and M.O. Miller, II Research Chair in Law and Professor of Law at Notre Dame Law School, where her scholarship focused on constitutional and statutory interpretation and the Federal courts. Judge Barrett has also served as a Visiting Associate Professor of Law at the University of Virginia Law School and the John M. Olin Fellow in Law at George Washington University Law School.

Earlier in her career, she practiced at the prestigious law firms Miller, Cassidy, Larroca & Lewin LLP and Baker Botts LLP. Judge Barrett clerked on the Supreme Court for Justice Antonin Scalia and for Judge Laurence H. Silberman on the U.S. Court of Appeals for the D.C. Circuit. She is a magna cum laude graduate of Rhodes College in Tennessee and a summa cum laude graduate of Notre Dame Law School, where she graduated first in her class. Florida Governor Ron DeSantis has moved the entire state into phase three of the COVID-19 recovery plan.  All restrictions against restaurants and businesses are removed by executive order [HERE] and all local mask ordinances are nullified by the same order.

♦ No COVID ordinance may forbid restaurants to operate below 50% capacity. Any local ordinances against these operational thresholds are nullified.

♦ No local mask ordinances shall carry any weight of enforcement.

Well, this MUST READ INTERVIEW should bring all efforts against Flynn to a halt.

U.S. Attorney for the Eastern District of Missouri, Jeff Jensen, has been conducting an ongoing review of the FBI investigation that led to charges in the case against Michael Flynn. As part of that review an interview was recently conducted (September 17, 2020) with the former Flynn supervisory case agent, William Barnett – who also was assigned to the Special Counsel’s Office investigating Russian interference in the 2016 Presidential Election.

What Special Agent Barnett says under oath about the DOJ and FBI investigations is devastating to the institutions.  Here is his 302 report:

Quite a bit of attention today to a release of information by Senate Judiciary Chairman Lindsey Graham [LINK HERE].  However, missed in most reviews is a duplicitous motive for Graham to claim “the primary source for the Steele dossier was likely a Russian agent.”

In essence, Graham is promoting a defense previously explored by James Comey that investigative elements of the FBI were duped by a Russian disinformation campaign; and as a consequence their investigative efforts were done under the most honorable of motives, but they were just tricked by Russians.  Ergo, see the Russians did interfere in the election.

That’s the justification narrative, and now Lindsey Graham has positioned everyone to support it; because the alternative is the DOJ and FBI knew it was Russia-centric and were coordinating to achieve a goal provided by the use of that disinformation campaign as purposefully fed by Chris Steele.

Just to drive home the point: the FBI wasn’t duped.  The FBI knew all along the Steele Dossier was a bunch of junk nonsense from political opposition research; but they needed it, to underscore the Carter Page FISA…. which they needed to justify the surveillance.
