The Fifth District Court of Appeals has yet to rule on the Writ of Certiorari submitted by Mark O’Mara.
The goal of the appeal is to override trial Judge Nelson’s ruling protecting Martin family attorney, Benjamin Crump, from deposition. Consequently this is the defense team’s attempt to compel Crump to answer questions about the evidence he submitted in the case.
Regardless of whether or not the defense team wins the appeal – the actual seating of Benjamin Crump seems highly unlikely. Crump learned his trade at the knee of the master, Al Sharpton, and there is no reason to believe a divergent outcome from Sharpton’s approach in the same regard when he was similarly disposed in the Tawana Brawley case.
It’s also expected the Zimmerman defense team should be releasing their 4th, and perhaps final, supplemental discovery release any time. Additionally, with the trail date closing in, there may be further reciprocal discovery released by the State of Florida.
According to the media/legal pundits the Jury selection could take 2 to 3 weeks.
Two attempts at motions to delay trial have been dismissed by the trial judge Debra Nelson. Without a substantive change, and high-threshold reasoning, it appears the trial will begin very soon.
We’ll be taking a trip back to Miami-Dade on Tuesday in an effort to get the Miami-Dade School Police Department to release the 10 sworn affidavits, and additional investigative records, requested as part of a Public Information (FOIA) Request. This request was made at the beginning of April confirmation of reception was rec’d and they were approved. Those affidavits are from the following:
On Friday April 20th 2012 Gerald Kitchell (then Major Kitchell) provided a sworn statement with internal affairs. Please provide a copy of that transcribed affidavit and all accompanying notes and reports. {Major Kitchell was the 2nd in command and first approached by Deanna Fox-Williams}
On Friday April 20th 2012, Lieutenant Roger Ramirez provided a sworn statement with internal affairs investigators. Please provide a copy of that transcribed affidavit and all accompanying notes and reports. {Ramirez was the Lieutenant who responded “oh now they want us to record things accurately”}
On Thursday March 30, 2012, Officer Darryl Dunn provided a sworn statement. Please provide a copy of that transcribed affidavit and all accompanying notes and reports. {Darryl Dunn is the Krop High School Resource Officer, he had the most frequent encounters with students, and the one who obfuscated the Criminal Mischief report – deleting the Jewelry}

Lastly, we requested the final report issued by Internal Affairs investigators which contains their findings, summation, and recommendations based on all their interviews and investigative research.
It has been two months since this request was delivered and confirmed. Obviously, the M-DSPD, through Miami-Dade School Superintendent Alberto Carvalho’s office is “Slow Walking” the release in an effort to avoid sunlight before the Zimmerman trial.
More than likely, as with the initial filings they initially denied existed, they are hoping we will just give up.
But we will not give up – we will continue to pursue and dig up the truth regardless of the ideological and manipulative hurdles placed afore us.
